The independence and impartiality of Supreme Court Justices are one of the critical issues in the concept of a democratic state. The facts show that in some countries, the judiciary’s independence is constantly under threat from political authorities (executive and legislative), because these two organs must ensure that their power is not disturbed by the court, which may legitimately counter-attack the ruling regime. The book illustrates the experience of Indonesia and India struggling to create a selection of the Supreme Court justice that ensure the quality of justices in upholding the independence and impartiality of the Supreme Court. This suggests that if the court can act independently, the country’s democratic consolidation will be successful due to the functioning of the checks and balances mechanism in the practice of the state. This book compares the models of Supreme Court justice appointment in Indonesia and India. The study’s goal is to perform a more in-depth examination of the strengths and shortcomings of appointing Supreme Court justice in both countries, as well as to develop a more perfect model for establishing an independent judicial institution.
